Contract Parties:
Supplier of the goods is Falegnameria Pescoller srl, Str. Damez, 33 39036 Badia, VAT number 01380500213, tax code 01380500213, registered with the Bolzano Business Register 01380500213.
Buyer: also referred to as the customer, is the person who, by registering on the website products.pescoller.com or via email or telephone, has purchased a product from the supplier mentioned above.
Prices and Conditions:
Prices are inclusive of VAT. Any transport costs or additional charges will be indicated in the order summary phase. The goods are produced upon order and are delivered within 3 weeks from the order date. Payment methods: Unless otherwise agreed, payment is made via cash on delivery or advance bank transfer.
Delivery:
The goods are delivered via courier. The buyer is obliged to check the integrity of the goods at the time of delivery and, in the event of external damage, to refuse the delivery. The supplier company cannot assume any responsibility for damage to the goods incurred after delivery, except for manufacturing defects. (See Warranty Terms section)
Withdrawal (Right of Cancellation):
The buyer has the right to withdraw from the sales contract within 14 days of receiving the goods. To exercise this right, the buyer must communicate their intention to withdraw from the contract and return the purchased goods via email to info@cirelax.com or via registered letter within 14 days of receiving the goods. The buyer must ship the goods to Falegnameria Pescoller srl, Str. Damez, 33, 39036 Badia, within 30 days of receiving the goods. Transport costs, packaging, and any risks associated with the return are borne by the buyer. Once the goods are received, the supplier will verify their condition and, if they comply with the original conditions, will proceed with the reimbursement, within 14 days from the date of receipt of the return, of the value of the goods.
Exclusion from the Right of Withdrawal:
The buyer cannot exercise the right of withdrawal if the purchased goods have been customized compared to the standard characteristics indicated on the website. The buyer cannot exercise the right of withdrawal if the purchased goods have been used or damaged. The right of withdrawal does not apply if the customer has purchased the goods for purposes related to their own professional or business activity, communicating their VAT number to the supplier for this purpose.
Warranty Terms:
For consumers, meaning those who purchase for purposes unrelated to their professional or business activity, Legislative Decree no. 24 of February 2, 2002, will apply (articles 1519-bis and subsequent articles of the Civil Code) – which provides for two years under the conditions of law. For other buyers, who usually purchase with a VAT number, the legal warranties referred to in articles 1490 and subsequent articles of the Civil Code will apply – which provides for one year under the conditions of law. The warranty does not cover any damage caused by the customer or deterioration due to the ordinary use of the goods.
